Bill Chamblee and Lynne Clarke recently obtained a favorable ruling from the district court in Titus County, granting summary judgment on all of Plaintiff’s causes of action. In this suit, Plaintiff alleged that he was injured when a ceiling-hung, gas-powered unit heater exploded. Chamblee Ryan represented an HVAC company that had contracted with the property owner to service some, but not all, of the heating and cooling equipment located on its property. Following briefing and oral argument, the court rightly found that the equipment for which the Defendant HVAC company was responsible did not include the thermostat, unit heater, or any other equipment that allegedly malfunctioned and that the HVAC company was entitled to judgment as a matter of law.
