Jeff Ryan and Stuart Carter recently obtained a defense verdict on behalf of a national trucking company in a wrongful death claim that was tried in the United States District Court, Southern District of Texas, Houston Division. Plaintiff was the mother of a 19-year-old who died after his motorcycle collided with the side of an 18 wheeler that was turning left into a warehouse parking lot. Plaintiff’s counsel alleged negligence on the part of 18-wheeler driver for failing to yield and failing to keep a proper lookout. Defendants argued that the deceased was driving at an excessive speed and was the sole cause of the collision. The plaintiff asked the jury to award $8 million. The jury returned with a defense verdict and the court entered a Take Nothing Judgement.
