Reagan Boyce Obtains Summary Judgment on Behalf of Treating Veterinarian

Plaintiff alleged that our client, a treating veterinarian who responded to an emergency call to treat a horse down in her stall was negligent in her care, and complicit in the alleged abuse by the trainer who had the horse in their custody. Our client only treated the horse on one occasion, in response to the emergency call, and contends her care was appropriate and the horse’s injuries were severe enough to warrant euthanasia. Plaintiff failed to support her claims with competent evidence by a veterinary expert, i.e., failed to obtain a veterinarian willing to offer an opinion against our client’s care and treatment. Despite the court giving plaintiff several opportunities to update her expert disclosures and submit evidence from those experts in support of her response to the MSJ she failed to do so. The Court granted the MSJ and dismissed the plaintiffs’ claims with prejudice.
