Reagan Boyce Obtains Dismissal Pursuant to Chapter 74

Newly named partner, Reagan Boyce, as she obtained a dismissal for entity defendant pursuant to Chapter 74 Section 351(b) for plaintiff’s failure to serve an expert report addressing claims for direct liability as against the client entity. The Court finding that an expert report that addressed liability of co-defendants only, for which client entity may have vicarious liability does not meet the requirements under Chapter 74 or the Court’s holding in the seminal case on this issue Certified EMS, Inc. v. Potts, 392 S.W.3d 625 (Tex. 2013).
