Jesse Lockhart Obtains Substantial Victory on Motion for Summary Judgment – Tarrant County, Texas

Associate Jesse Lockhart argued a No Evidence and a Traditional Motion for Summary Judgment against Plaintiff’s claims of Negligence, Premise Liability, Negligent Activity, Negligent Undertaking, Respondeat Superior and Gross Negligence against the manufacture of semi-truck hoods. Plaintiff alleges he was injured while at Defendants’ premises during the loading of his semi-trailer. The case is filed in the District Court – 342nd Judicial District, Tarrant County, Texas.

After considering arguments from counsel as well as the briefs from both sides the Court dismissed all of Plaintiff’s claims except general negligence against the Defendant employee.

Jesse was assisted by Associate Vincent Loreto who assisted in drafting both Motions for Summary Judgment, as well as the Reply brief to Plaintiff’s Response to Defendants Motions for Summary Judgment.

Overall, this is substantial victory for the client as the Plaintiff only has one narrow claim against the Defendants which can be factually countered at trial.
