Jeff Ryan and Jarad Kent, with assistance from Betty Shu, obtained a unanimous no negligence defense verdict on behalf of an Athens, Texas family practice physician in the 392nd Judicial District Court of Henderson County, Texas. Plaintiff claimed that the family practice physician failed to timely diagnose stage IV small cell lung cancer and that the timing of the diagnosis caused the decedent pain, suffering, and mental anguish. At trial, Plaintiff sought nearly $500,000 in damages for the decedent’s claimed conscious pain, suffering, and mental anguish. After less than thirty minutes of deliberations, the jury returned a unanimous verdict finding no negligence on the part of the family practice physician.
