Jeffrey W. Ryan and Jarad L. Kent obtained a unanimous defense verdict on behalf of a North Texas orthopedic surgeon in the United States District Court for the Northern District of Texas, Dallas Division. The Plaintiff, a Division I collegiate athlete, alleged that the orthopedic surgeon had caused thermal damage to the cartilage and bone on the undersurface of her patella during an arthroscopic knee surgery. Through the presentation of evidence from the orthopedic surgeon, the plaintiff herself, a subsequent treating physician, and other experts, the jury considered all evidence of the plaintiff’s extensive history of prior knee problems, the conservative course of treatment used by the orthopedic surgeon, and the manner in which the orthopedic surgeon performed the arthroscopic surgery to address plaintiff’s knee problems. Through this evidence, Mr. Ryan and Mr. Kent were able to successfully show the jury that their client’s care and treatment of the plaintiff was entirely appropriate and well within the standard of care.
