Jeff Ryan and Jarad Kent obtained a favorable verdict for an East Texas Doctor after a four day jury trial. Plaintiffs asked for in excess of $2.5M from the jury during their closing arguments, claiming assault and false imprisonment, in addition to negligence, gross negligence, and malice. After 3 hours of deliberations, the jury was unanimous that there was no assault and no false imprisonment. The jury found the plaintiff and defendant both were negligent, and assessed 50% proportionate responsibility to each party. The jury awarded only $50K in damages, which was reduced to $25K after taking into account the plaintiff’s 50% proportionate responsibility. The jury unanimously found no gross negligence or malice.
