Douglas R. Lewis and Kimberly K. Bocell obtained a unanimous defense verdict in a medical malpractice lawsuit in Dallas County. Plaintiff claimed that the Defendant, a board-certified OB/GYN, failed to properly evaluate and treat her for a post-partum infection following the uneventful delivery of her baby. Plaintiff sought economic and non-economic damages in excess of $650,000.00. Defendant argued that Plaintiff’s post-partum course was normal and expected and that she never showed signs of an infection prior to her discharge. Instead, once at home, she developed a rare, aggressive, unforeseeable infection in her lungs that quickly turned into sepsis. The Plaintiff returned to the hospital the next day and her infection was diagnosed and successfully treated during a lengthy hospital course. The jury returned their unanimous verdict for the Defendant-Physician after just 41 minutes of deliberation.
