Doug Lewis and Kimberly Bocell successfully defended a pediatrician and physician assistant in Collin County. The Plaintiff, the father of a young boy, alleged that Defendants failed to properly treat his son’s skin condition and failed to give proper post-treatment instructions, leading to the development of painful blisters at the site of the treatment, requiring additional treatment. Defendants claimed that their care and treatment of the boy was 100% appropriate, that they provided appropriate post-treatment instructions, and that the child’s mother failed to follow the post-treatment instructions, which is what lead to the development of the blisters. The jury agreed with Defendants, finding no negligence by Defendants, and instead finding that the mother acted negligently in the care of her son. They returned their unanimous defense verdict after only about 30 minutes of deliberations.
