Jeff Ryan and Jarad Kent, with the assistance of Alison Williams, successfully obtained a complete dismissal of all claims in a slip and fall premises liability case filed against an East Texas hospital. The Court agreed with the hospital’s position that the case qualified as a health care liability claim pursuant to Chapter 74 of the Texas Civil Practices and Remedies Code, and thus plaintiff was required to serve a Chapter 74 expert report. Based on plaintiff’s failure to serve the requisite report, the Court dismissed plaintiff’s case in its entirety.
