CHAMBLEE RYAN’S TRIAL WINS CONTINUE

Reagan Boyce obtains an unanimous defense verdict in veterinary malpractice case in Parker County, Texas. This case involves allegations of negligence by veterinary clinic and its board-certified veterinarian for wrongful castration of alleged future cutting horse champion. Plaintiffs were seeking in excess of $1.5 million in lost future breeding fees due to the unintended castration of their American Quarter Horse. Although the trainer admitted to the mistake in having plaintiff’s horse castrated, the plaintiffs sought to blame the veterinarian and the veterinary clinic for the wrongful castration and failure to obtain the owner’s consent. Texas law provides that a veterinarian client patient relationship can be formed with the owner, or another caretaker, in this case the trainer who had possession of the horse and was boarding the horse at the training facility. The jury verdict confirms that the veterinarian and clinic acted within the standard of care at all times in obtaining the consent of the trainer to castrate the horse.
