William Chamblee and Weston Hall just completed trying a lawsuit where the plaintiff alleged a traumatic brain injury along with severe facial fracturing and a lengthy one month hospital stay following an ATV accident wherein the plaintiff was a passenger. Plaintiff was riding in the back of a two-seater ATV. One of our clients was driving the ATV and the plaintiff was ejected from the back seat of the ATV on a ranch road. The allegations were negligence in handling and driving the ATV, negligence regarding modifications made by the owner (also our client) of the ATV and claims not only of negligence, but of gross negligence and substantial damages including a traumatic brain injury. Through approximately 20 minutes of jury deliberation, the jury returned a verdict for the defendants and all regard.
