Bill Chamblee, with the assistance of Michael Hearn, successfully defended an employer against allegations of a Claimant employee who asserted the negligence of a co-worker injured the Claimant. Claimant asserted that while he and his co-worker were moving a pallet jack the co-worker negligently pushed the pallet jack, causing Claimant to fall to the ground. Claimant sought $2,251,086.74 in damages.
After three days of evidence the arbitrator found that the employer provided proper training and supervision to its employees, that the company and Claimant’s co-worker were not negligent, and that Claimant’s own conduct was the sole cause of his injuries.
