William H. Chamblee and Weston L. Hall Obtain a Significant Victory in Bexar County

William H. Chamblee and Weston L. Hall fought off an effort by Plaintiff to win more than $5,000,000 and secure a verdict for gross negligence against a large commercial trucking company with business throughout Texas. Plaintiff alleged that the minor sideswipe accident caused him significant medical damages, necessitating surgery and preventing him from working. Over a six-day trial in the 407th Judicial District in Bexar County, the jury heard extensive evidence on how the accident occurred and the medical condition of Plaintiff.

Despite our limited arguments on liability, the jury put fifty percent of the fault for the accident on Plaintiff. The jury also did not believe his alleged damages were caused by this accident. The jury awarded money for past medical care and limited future medical care. The jury made no award for pain and suffering or future disfigurement. When the comparative negligence finding was considered, our clients’ portion of the jury award was just over $70,000, less than what was being offered in settlement discussions shortly before trial. This was a significant victory for our clients in a hard fought case.
