William H. Chamblee and Kimberly K. Bocell Obtain Defense Verdict in Medical Malpractice Case ◦ Health Care

William H. Chamblee and Kimberly K. Bocell successfully defended an anesthesiologist and his practice group in County Court in Dallas County in April 2015.  The Plaintiff and her family alleged that the Defendant-anesthesiologist provided a spinal analgesic injection for post-operative pain management at the wrong level and directly into her spinal cord resulting in paralysis from the waist down, based primarily on a CT scan that showed an abnormality at the bottom of the patient’s spinal cord.  Defendants and their experts argued that (1) the injection was provided at the correct level and did not puncture her spine, as documented in the anesthesia record; (2) the “abnormality” at the bottom of Plaintiff’s spinal cord was a normal anatomic variant seen in some people; and (3) Plaintiff’s claimed paralysis was either feigned or psycho-somatic.  The jury agreed with Defendants and returned a unanimous defense verdict on behalf of the anesthesiologist and his group after just 30 minutes of deliberations.
