The final version of the rule raises the minimum salary threshold to qualify for the Fair Labor Standards Act’s white collar exemption. “One of the aspects of the rule that, I think, is getting overlooked is the requirement to establish a mechanism for automatic increases,” says Mr. Davis “This didn’t happen before, of course, and employers will have to be even more plugged-in to the regulatory changes to ensure continued compliance with the regulations. Future changes aren’t likely to get as much press but the penalties will still be the same. “
