Recently, Judge Meredith Kennedy of the Texas 78th Judicial District Court granted our client’s motion for summary judgment, affirming the protection provided to landowners in premises liability. The case involved an accident where the plaintiff, an invitee of the business was struck by a glass door blowing in the wind.
Chamblee Ryan attorney Vincent Loreto effectively argued landowners are generally not liable for injuries under premises liability when they lease a property. Generally, a lessor owes no duty to tenants or their invitees for dangerous conditions on leased premises. This is because in a lease arrangement, the lessor transfers possession and control of the leased premises to the tenant.
Judge Kennedy’s ruling confirmed that our client had fulfilled all statutory requirements as a landowner.
