Brittany Osemwengie was successful in obtaining a dismissal of a veterinary medical malpractice suit after receiving a favorable ruling on a summary disposition motion from the justice court in Bosque County. The lawsuit involved claims of negligence by the veterinarian arising from the passing of the plaintiffs’ Shih Tzu. The plaintiffs’ alleged that our veterinarian caused the death of their dog after taking a medication prescribed during their last veterinary visit. Damages claimed and asked for were $20,000. Ms. Osemwengie stated that the plaintiffs did not have the required expert opinion needed to prove their claim of negligence. Following a brief hearing on the motion, the Court sided with the defendant, finding that the plaintiffs did not have proper evidence to prevail in their case as a matter of law.
