William H. Chamblee and Caleena Svatek obtain a take-nothing defense verdict for a pool construction company in Rockwall County, Texas. The Plaintiffs, former customers of the pool company, alleged breach of contract and warranties for the construction of a negative edge pool. Plaintiffs sued the pool construction company claiming that Defendant did not provide numerous items represented to them in the contract and the pool was not properly functioning. Plaintiffs sought in excess of $100,000.00 and attorney’s fees. Mr. Chamblee and Ms. Svatek, on behalf of the pool construction company, argued that Plaintiffs’ complaints were never part of the contract and that no warranties were breached because Defendant was always willing to correct any warranty-related issue, which Plaintiffs had never complained of until the lawsuit. After a couple of hours of deliberation, the jury returned a 11-1 defense verdict.
