Bill Chamblee, Jeff Ryan, and Jarad Kent successfully defended a Dallas-based industrial hose assembler in a statutory indemnification case arising out of a prior products liability case. The Plaintiff in the indemnification action was a co-defendant in the underlying products liability action who had rented the industrial hose that was the subject of the underlying products liability action. The rental company was seeking to recover from the hose assembler approximately $850,000.00 that it paid to settle the underlying products liability action, as well as an additional $100,000.00 in attorneys’ fees and expenses incurred in both defending itself in the underlying products liability action and in attempting to obtain indemnification from the hose assembler.
Attorneys Bill Chamblee, Jeff Ryan, and Jarad Kent defended the local hose assembler at trial, convincing a Dallas County jury that the rental company’s own independent conduct was a 70% cause for its losses arising out of the underlying products liability action, thereby completely barring its claim for indemnification from the hose assembler.
