Jim Fendley obtained a unanimous defense verdict in Polk County, Texas yesterday despite the investigating officer placing responsibility for the accident on the Defendant truck driver. Plaintiff contended that the Defendant driver was negligent for failing to yield the right-of-way when the driver pulled across and blocked multiple lanes of traffic so that he could straighten his 18-wheeler and then back into his destination. Moreover, the police report stated that the Defendant driver was responsible for the accident based on a failure to yield the right-of way. After less than 20 minutes of deliberation, the jury returned a unanimous defense verdict stating that the Defendant driver was not responsible for the accident.
