• A plaintiff sued a spine surgeon who performed a lumbar posterior instrumented fusion. Plaintiff underwent an anterior fusion that same year. The plaintiff's expert claimed that the surgery was unnecessary and that plaintiff was permanently disabled from the procedure. The jury returned a unanimous verdict in favor of the defense.
• A 15-year-old patient sued an orthopedic surgeon claiming the physician failed to diagnose and treat an infected hematoma. The physician had examined the patient on two separate occasions, and the patient needed treatment and surgery soon after, at another facility. The jury found for the defense.
• A physician was sued by a family following the death of family member. Plaintiffs claimed the death resulted from a mixed-drug overdose of OxyContin and Darvocet. After one and a half weeks of trial, the trial court ruled in favor of the defendant.
